Users will find here all information regarding the legal terms and conditions that define the relationship between them and SELECCION DIGITAL 3.0 SL, which reserves the right, without limitation, to modify the Website, including its configuration and any services it deems appropriate, without prior notice. SELECCION DIGITAL 3.0 SL defines as Candidate (hereinafter "Candidate") any natural person user seeking employment or related professional services who uses the services of SELECCION DIGITAL 3.0 SL and accesses the Websites owned by SELECCION DIGITAL 3.0 SL; and as Company (hereinafter "Company") any entity using the services of SELECCION DIGITAL 3.0 SL that accesses the Websites owned by SELECCION DIGITAL 3.0 SL to advertise job offers or search "CVs" in the SELECCION DIGITAL 3.0 SL database. For the purposes of these Legal Conditions, Candidates and Companies are jointly referred to as "Users". It is important to be aware of these terms before continuing to browse. SELECCION DIGITAL 3.0 SL will not collect personal data without prior authorisation from the data subject.
SELECCION DIGITAL 3.0 SL provides Candidates and Companies with an online matching platform to foster contact between them, promoting employability and quality in hiring. These Legal Conditions aim to regulate access to and use by Candidates and Companies of the services available on the page https://www.jobfie.es/, including access to job offers for Candidates and access to "CVs" for Companies, always in an environment of registration and data protection as registered by SELECCION DIGITAL 3.0 SL, with access conditional on prior registration in the corresponding database.
SELECCION DIGITAL 3.0 SL is a dynamic platform, under continuous development and evolution. In certain cases, Users must consult and accept the applicable Conditions. Use of the Website implies acceptance of and compliance with the provisions of the Legal Conditions published by SELECCION DIGITAL 3.0 SL at the time of access. If SELECCION DIGITAL 3.0 SL detects any illegal or presumably illegal content, it will remove such content from the Website without prior notice.
SELECCION DIGITAL 3.0 SL makes use of the Website conditional on most services being subject to prior completion of the corresponding User registration, including selection of identifier (ID or Login) and password. Users undertake to use and keep them diligently. Use of the password is personal and non-transferable and may not be assigned to third parties. The User is responsible and must take whatever measures they deem appropriate for its protection, fully releasing SELECCION DIGITAL 3.0 SL from any liability. Regarding possible disputes between Users, SELECCION DIGITAL 3.0 SL reserves the right to monitor them and, if it deems necessary to limit, suspend or close the User's account for proper compliance with these Legal Conditions, it will do so at its discretion.
Obligation to provide truthful information, guaranteeing the authenticity of any data communicated for use of the Website, and to be over 16 years of age and responsible for keeping personal data up to date.
All information provided by the User through the services must be truthful. The User confirms that they are over 16 years of age and that all data provided in the forms required for subscription to the Web Services is authentic. The User is solely responsible for keeping the information provided to SELECCION DIGITAL 3.0 SL permanently updated, reflecting their real situation at all times, and assumes all responsibility arising from false or inaccurate use or statements, and for any damage caused to SELECCION DIGITAL 3.0 SL or third parties.
The following are prohibited, by way of illustration and without limitation: use of content deemed defamatory or slanderous, pornographic or in breach of child protection laws; advertising; inconveniencing other Users (especially through spam); using legally protected content without entitlement; offering or distributing legally protected goods or services; and undertaking or encouraging actions contrary to free competition, including progressive client solicitation, and in general acting against the Spanish legal system. Users who breach any of the above obligations in bad faith or through negligence shall be liable for all damage caused.
5.1 General conditions Although the Candidate is aware that SELECCION DIGITAL 3.0 SL does not intermediate in selection processes or in any way in the relationship between Candidate and Company, and that SELECCION DIGITAL 3.0 SL is not party to the relationship between the two, the Candidate nevertheless has an obligation to guarantee the accuracy of the personal information provided to SELECCION DIGITAL 3.0 SL and to keep it updated, and is solely responsible for any inaccuracy or falsity of the data provided to SELECCION DIGITAL 3.0 SL and for any damage that may be caused to SELECCION DIGITAL 3.0 SL or third parties from use of the services offered by SELECCION DIGITAL 3.0 SL.
5.2 Data visibility SELECCION DIGITAL 3.0 SL informs the Candidate that there are two types of data visibility:
a) Full visibility. Companies searching our database can see your full CV.
b) CV not visible. Your CV will not appear in searches carried out by companies in our database; it will only be visible to companies whose offers you apply to.
You can change your visibility at any time by accessing your User area, "Account preferences" section, "How companies find you" section; each change will be saved automatically.
The Company certifies to SELECCION DIGITAL 3.0 SL that all information and details of the job offer comply with current legislation, respecting the guidelines of the relevant collective agreement and without contravening labour regulations. The Company also guarantees to SELECCION DIGITAL 3.0 SL that all its personal or business data is accurate and true, reflecting the current situation of the Company at all times, and undertakes to keep it updated. It is solely responsible for any inaccuracy or falsity of the data provided to SELECCION DIGITAL 3.0 SL and for any damage caused to SELECCION DIGITAL 3.0 SL or third parties from use of the services offered by SELECCION DIGITAL 3.0 SL.
Abandoning an ongoing selection process: If a selection process already started is abandoned, any candidate information may continue to be available to selecting companies. However, if this were to breach data protection regulations and the privacy policy and/or unauthorised use of data were to occur as a result of information processing, SELECCION DIGITAL 3.0 SL would not be responsible for such actions, reserving the right to take whatever legal action it deems appropriate.
SELECCION DIGITAL 3.0 SL informs you that in cases where candidates voluntarily end their relationship with the platform, all information obtained from them must be destroyed and may not be used by the entity for any other purpose. The entity may only handle candidates' personal information when they are exclusively within the framework of the Website.
11.1 PricesOn SELECCION DIGITAL 3.0 SL, companies may purchase job offer packs. Each job offer package indicates the service price without any additional discount. Prices on the website do not include applicable VAT and other applicable taxes. SELECCION DIGITAL 3.0 SL may occasionally offer limited discounts and offers to some of its users, which may reduce the price during the offer period. Website prices are final and users need not pay any extra amount during the personnel selection search process. These prices may be modified at any time on the website.
11.2. Service start, payment conditionsThe service will take effect when the Company expresses its agreement and acceptance of the legal contracting conditions and sends us the duly signed service request and Company form with the payment conditions. The Company also declares that it has read and accepts these conditions in full. In consideration for the service, the Company will pay SELECCION DIGITAL 3.0 SL the amount indicated in the "Service Request", always respecting the duration and payment conditions indicated therein. SELECCION DIGITAL 3.0 SL reserves the right to discontinue and/or modify the characteristics of contracted services by migrating them to equal or superior services, informing the Company with a minimum of thirty (30) days' notice. However, the Company may terminate the contract without penalty within thirty (30) days of notification of the modification by SELECCION DIGITAL 3.0 SL.
11.3. Grounds for terminationSELECCION DIGITAL 3.0 SL may terminate the contract if the Company breaches any of its obligations under these conditions, rules of use and service conditions, and does not remedy such breach within ten (10) calendar days of notification by SELECCION DIGITAL 3.0 SL. During this period SELECCION DIGITAL 3.0 SL may suspend the service. In the event of termination of this contract by SELECCION DIGITAL 3.0 SL as a result of breach by the Company, the Company must pay the amounts due for services provided by SELECCION DIGITAL 3.0 SL with no option for full or partial refund of contracted services.
11.4. Refund policyIn accordance with the Consolidated Consumer and User Protection Act: The Company will have a period of fourteen calendar days from the start of the subscription, including any free period if applicable, to exercise the right of withdrawal if not satisfied with the services purchased. This right shall only apply to the first payment made by the Company and not to recurring or subsequent charges, provided that the Company has not used the service or begun to use it (use or consumption is understood not to have begun when the Company has not published a job offer). It is the Company's responsibility to cancel its subscription within the month before the next charge.
All Portal content, including but not limited to distinctive signs, texts, photographs, software, technology and other content, both audiovisual and sound, is the industrial and intellectual property of SELECCION DIGITAL 3.0 SL or third parties. Its use, reproduction, distribution, public communication, transformation or any similar action is strictly prohibited without express written authorisation from the creator or rights owner.
